What are the required strata fire protection needs?

Strata owners have a legal responsibility to ensure the safety of all individuals on their property, including residents, tenants, staff, contractors, and visitors. To meet this obligation, strata owners must follow fire safety regulations and ensure that all fire protection measures are properly assessed and endorsed by an Accredited Practitioner (Fire Safety). This process, known as the Annual Fire Safety Statement (AFSS), is required by the NSW Environmental Planning and Assessment Regulation 2000. As of July 1, 2020, strata owners are required to obtain an AFSS or Fire Safety Certificate and provide copies to both the council and the NSW Fire Brigade. A copy of the statement or certificate must also be prominently displayed in the building.

Obtaining a Fire Safety Certificate and Fire Safety Schedule for your Strata Property

In order to ensure fire protection in new construction or significantly altered strata buildings, a Fire Safety Certificate must be obtained. This certificate outlines all of the necessary fire safety measures for the strata property and must be prepared by a registered fire safety professional. Once completed, the certificate is submitted to the local council for approval. Previously, this certificate was known as a Form 6 or Form 15 Certificate.

In addition to the Fire Safety Certificate, a Fire Safety Schedule (FSS) must also be created for the property. The FSS lists all of the fire protection systems and equipment required, as well as the necessary standards or requirements for each item, such as Building codes and Australian Standards. The FSS must be assessed, tested, and serviced by an accredited person.

An FSS can be obtained through a council inspection or by submitting a records request to the council if the necessary data is on file. Accredited certifiers, including certified fire protection professionals, can also issue Fire Safety Schedules.
